The environment
These are the community guidelines for the Nuance Discussion Forums, which are developed and maintained by the Nuance Community Manager along with additional Forum Moderators. These guidelines apply to any communication and related content within these discussion forums.

Nuance Discussion Forums and the Customer Support Portal make use of the same user database, so registering your retail product through our Registration Site or through our Support Portal registers you on the forums and vice-versa.

Nuance Discussion Forums are community-driven websites for people of all ages to share news, challenges, best practices, and tips & tricks, while using your Nuance software. This means that most of the content available to you on these discussion forums is generated by members of the site and not the staff or administrators of the site(s).

General rules
Please take a moment to review these rules and insure you understand and agree with them. These rules are used as a general guideline by administrators and moderators of the Nuance Discussion Forums and it is important you are aware of them if you want to share content on this site. It is important to also acknowledge that there may also be rules and etiquette that are not mentioned here but are still upheld by administrators and moderators of the site.

We reserve the right to change these Community Guidelines at any time. It is the sole responsibility of members to stay updated with these guidelines. Major amendments to the rules will be clearly announced on the News and Announcements section within the forums.

The official language of the Nuance Discussion Forums is English and English should be the primary language used at all times. We reserve the right to remove any content from the Nuance Discussion Forums that isn't written in English.

Through your use of the Nuance Discussion Forums, you agree that you will not post any material which is self-promoting, false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, threatening, related to piracy, invasive of a person's privacy, or otherwise in violation of US law. Know that in severe cases legal action can be taken against you.

The posting of copyrighted material, unless the copyright is owned by you or you have consent from the owner of the copyrighted material, is strictly prohibited within these forums. This includes linking to sites that contain copyrighted material used without permission of the copyright holder. Legal inquiries regarding copyright infringement are taken very seriously on the Nuance Discussion Forums and we will work with any legal body to identify and bring to justice anyone who might use these forums to share copyrighted material.

Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are not allowed within these community forums.

Due to the community-driven nature of the Nuance Discussion Forums, it is impossible for us to confirm the validity of all the content available on these sites. Nuance does not actively monitor every piece of user-generated content uploaded or added to a product forum. Nuance does not warrant the accuracy, completeness or usefulness of any content presented and is not responsible for any harm that comes from the use of this material. User-submitted content expresses the views of the author, not necessarily the views of any staff of Nuance Communications, Inc.  Anyone who feels that user-generated content uploaded to Nuance is objectionable or falls outside these Community Guidelines is encouraged to report abuse of this content immediate. If you believe someone has posted any content that is against these community guidelines, please report the content but do not contact the offender by any means. Leave any and all disciplinary action to the staff of the Nuance Community.

Creating a new account

You have the ability, as you register, to choose a username. We advise that you keep the name appropriate. You agree to never give your password out to another user of the site outside of the administrators of the site for your protection and for validity reasons. You also agree to never login to another account that does not belong to you. People caught sharing their accounts will have them banned from accessing the site and every attempt will be made by the administrators of the site to make sure you cannot create a new account.

Members are only allowed to be in possession of one account on the site. Members caught using more than one account will be regarded as attempting to exploit or circumvent features on the site and will have both their accounts banned.

Members have the ability to customize their profiles within the Nuance Discussion Forums, making them more noticeable and unique. Two of the main identifiable attributes of a member profile are the avatar and profile photo. These user profiles have strict guidelines for member avatars, which are listed below:

  • Avatar images are cropped to 100x100 pixels. Supported file types: GIF, JPG, PNG. Maximum file size: 3MB.

Nuance staff:
Nuance Discussion Forums are staffed by the Community Managers as well as other Nuance employees who serve as the forum moderators.  These individuals work hard to insure the smooth operation of the Nuance Discussion Forums and encourage a healthy community. The moderators and other administrators on the site have been given specific privileges to keep the site clean of the bad content listed in these terms and use their own personal judgment, to arrive at those decisions.

These moderators have a right to carry out their task without harassment, insult or hassle. Members who believe that a member of staff is not conducting themselves properly should get in contact with the Community Managers.
Piracy
We have a strict anti-piracy policy on these forums and we take a proactive and pre-emptive stance on anyone we believe is using a pirated version of any piece of software.
If you give us reason to believe that you are a software pirate you will be instantly banned.

User-generated content and the rights to removal
By submitting or otherwise posting content to the Nuance Discussion Forum, you hereby grant Nuance and its affiliates, a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content, and/or to incorporate it in other works in any form, media or technology now known or later developed without any compensation or obligation to you. If you do not want to grant to Nuance the foregoing rights, do not post content to the Nuance Discussion Forum.

You remain solely responsible for the content you upload to the Nuance Discussion Forums and you agree to indemnify and hold harmless this site, and any related websites.

You represent and agree that you are responsible for the content that you submit to the Nuance Discussion Forums and that you have obtained all necessary rights, licenses or clearances to disclose all such content.  You further represent and agree that you may not submit or transmit any content that:

(a) violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights;

(b) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, is invasive of another's privacy, or solicit/post sexually explicit material;

(c) uses racially, ethnically, or otherwise offensive language;

(d) impersonates any person, business or entity, including Nuance and its employees and agents;

(e) contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network;

(f) to advertise, offer for sale or otherwise sell any products or services; or

(g) violates these guidelines.

We reserve the right to reveal your identity (or any information we have about you) to authorities in the event of a complaint or legal action arising from any information posted by you.

We have the right to remove any content we deem objectionable at any time and without warning or reason.

By uploading content to the Nuance Discussion Forums you agree to allow administrators of the site to store and present the content whenever and where ever the administrators deem necessary until such time as a request is received by the original user for the content to be removed. Removal of content is a manual process, however, so please realize that we may not be able to remove or edit content immediately.

File and image database commenting and rating

Please take the time to read and understand the following before commenting on any files or images uploaded to this site.

We have a strict zero-tolerance policy for the breaking of our terms and Members may and will be banned from the site without warning if they ignore them. Remember; ignorance is not an excuse.

The commenting, endorsement and rating system is available on the Nuance Discussion Forums to provide users with:

  • an interface to offer positive feedback on the functionality of the content in question based on the author’s initial intentions
  • the ability to offer constructive criticism on aspects of the content that could be improved
  • the chance to ask for feature requests and discuss such requests with other users of the site or the author
  • the ability to ask for help in troubleshooting problems with the content in question

If your comment does not fit in to the above criteria then do not post. If you disagree with the content of a specific post on the site then do not reply. Simply ignore the post and move on. If you believe the content of a post breaches the Nuance terms and conditions then please report the post for moderator viewing and move on, do not take matters in to your own hands.

If your comment contains text that is likely to personally offend other users of the site either in the language you use or the message of your text then do not post. We take personal attacks very seriously and you will be banned without warning.

If you believe that someone else’s post does not fit into these criteria then you are encouraged to report the comment in question for moderator review. Above all do not post in reply to the offending comment however good intentioned your post might be, even if you are the author of the post in question. This is known as “feeding the trolls” and “forum vigilantism” and is frowned upon by the moderator staff. You may well end up with a suspension from the site if you partake in this activity.

This site has dedicated moderating staff that have full authority to edit and delete posts as well as ban accounts instantly and without warning. However the moderating staff cannot possibly read and keep up-to-date with every single comment, rating and file posted on the site. It is up to you, the users of this site, to help keep this site clear of the people who just want to ruin it for everybody by reporting violations of these conditions to the moderators, either through the provided reporting features on the site or via forum PM to the moderating staff.

Uploading files and images

The primary role of the Nuance Discussion Forums is to provide a platform for members to share their content with other members of the site via the file and image databases respectfully. Content uploaded to the Nuance Discussion Forums is not immediately moderated by members of staff and is instantly available for download once the member agrees to publish the content on the site. While such a system is open to exploitation, the moderation staff is extremely astute and removes rule breaching content in very acceptable times. We do however rely on members of this site to help us in moderating content uploaded to the Nuance Discussion Forums by reporting any content the user deems to be in breach of the file sharing rules. People exploiting the open nature of the forums will be banned without warning and with extreme prejudice and every attempt will be made to insure that person is not able to use the site again and, if necessary, reported to the relevant authorities for further action.

You acknowledge that we do not prescreen information or material submitted by users of the Nuance Discussion Forums.  Nuance retains the right, but not the responsibility, to edit or remove any content, including those deemed by us to violate these guidelines.  You acknowledge and agree that we are not responsible for examining and evaluating the content provided through the Nuance Discussion Forum. You understand that we do not guarantee the accuracy, integrity or quality of such content, and your use or reliance on any such content shall be at your sole risk.  Nuance does not warrant or endorse and does not assume and will not have any liability or responsibility for any content provided through the Nuance Discussion Forum, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content.  The Nuance Community Forums has quite a liberal content policy on what files are acceptable on the site but there are still rules all users must adhere to. Failure to adhere to these rules will result in the post being removed from the site, the user’s account being banned and if necessary all the details of the user being passed on to relevant authorities.

These rules are open to interpretation by moderators of the site and they can and will remove any content they deem to be inappropriate for the Nuance Discussion Forums.  We retain the right to remove or edit details of any file at any time for any reason without warning.

DISCLAIMER OF WARRANTIES. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE NUANCE DISCUSSION FORUM IS AT YOUR OWN RISK.  WE MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES REGARDING THE CONTENT, INCLUDING BUT NOT LIMITED TO THE ACCURACY, INTEGRITY, QUALITY, SUITABILITY, OR COMPLETENESS OF ANY CONTENT.  THE NUANCE DISCUSSION FORUM AND ANY CONTENT CONTAINED THEREIN ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SPECIFICALLY DISCLAIM ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
